BookPoint Terms of Service
1. The service
BookPoint is an online platform for businesses that work by appointment. It gives each business its own booking site where customers book and manage visits, a panel to manage the calendar, services, team and customers, appointment reminders by email and text message, and tools to record and invoice payments taken at the business.
These terms are an agreement between BookPoint ("we", "us") and the business that creates an account ("you"). By creating an account you confirm that you accept them and that you are authorized to accept them on behalf of the business.
BookPoint does not take online payments from your customers. Payments for your services are made at your business and you only record them in BookPoint.
2. Your account
You must give accurate information when you sign up and keep it up to date. You are responsible for everything done with the accounts of your business, including the users you invite, and for keeping passwords safe. Tell us right away if you think someone has accessed your account without permission.
The web address of your booking site (your subdomain) must not imitate another business or brand. We may change or remove a subdomain that does.
3. Free trial, plans and billing
Each new business gets a free trial of the length shown on our website when it signs up (currently two months). No payment method is needed to start the trial.
To keep using BookPoint after the trial, choose a monthly plan and set up payment through our payment provider (currently PayPal). If you set up payment during the trial, the first charge is made when the trial ends. After that, the plan renews and is charged every month until you cancel. Prices are shown in US dollars and do not include taxes, which are added where the law requires them.
Each plan may limit how many team members you can add. If you change plan, the new price applies from the next billing date, unless the payment provider shows you otherwise when you confirm the change.
We may change plan prices with at least 30 days' notice by email. The new price applies from your next billing date after that notice.
4. Cancellation and suspension
You can cancel at any time from Plan & billing in your panel. If you cancel during the trial, nothing is charged. If you cancel a paid plan, no further charges are made; amounts already charged are not refunded unless the law requires it.
If the trial ends without a plan, or a payment fails, we will let you know and give you a grace period (currently seven days) to pay. If it ends without payment, your booking site and panel are suspended until the plan is paid. Paying reactivates them.
We may also suspend or close an account that breaks these terms, puts other people at risk or uses the service unlawfully. When it is reasonable, we will tell you first and give you a chance to fix the problem.
5. Your customers and your content
You decide what your business offers, its prices and its policies, and you are responsible for the services you provide to your customers. The content you add (texts, photos, logos, services) remains yours. You give us permission to host, copy and display it only to run the service for you.
For the personal information of your customers that you collect through BookPoint, you are responsible for having a lawful basis to collect it and for following the privacy and consumer laws that apply to your business. We process that information on your behalf and following your instructions, as described in our Privacy Policy.
Do not use BookPoint to collect sensitive information that it is not designed for, such as health records, payment card numbers or government ID numbers.
6. Acceptable use
You agree not to use BookPoint to break the law, to send spam or unwanted messages, to publish content that is false, offensive or that infringes the rights of others, to try to access other businesses' data, or to interfere with the security or operation of the service.
7. Email and text messages
BookPoint sends appointment confirmations and reminders to your customers on your behalf. Text messages are only sent to customers who agreed to receive them when they booked, and every message includes how to stop them. You must not ask us to send marketing messages to customers who have not agreed to receive them.
8. Your data and export
You can download a copy of your business data from your panel at any time. If your account is closed, we keep the data for a reasonable period so you can recover it or export it, and then we delete it, except what we must keep by law.
9. Availability and changes
We work to keep BookPoint available and secure, but we cannot promise that it will always be available or free of errors. We may improve or change features. If a change removes something essential that you pay for, we will tell you in advance.
10. Disclaimers and limitation of liability
To the extent the law allows, BookPoint is provided "as is", without warranties of any kind. We are not liable for indirect, incidental or consequential damages, or for lost profits or lost data. Our total liability for any claim related to the service is limited to the amount you paid us in the twelve months before the claim.
11. Governing law
These terms are governed by the laws of the United States and of the State where BookPoint has its principal place of business, without regard to its conflict of law rules.
12. Changes to these terms
We may update these terms. If a change is important, we will tell you by email or in your panel before it takes effect. If you keep using BookPoint after that date, you accept the new terms.
